Terms of Service

These Terms of Service (the “Terms”) are a legal agreement between you and Peachy Limited (“Peachy”, “we”, “us”, “our”) governing your access to and use of our link shortening, QR code generation, forms and bookings, landing pages, analytics, and social platform integrations (the “Services”). By creating an account, using the Services, or clicking “accept,” you agree to these Terms. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization. If you do not agree, do not use the Services.

• Eligibility

  You must be at least 16 years old to use the Services. If you are under the age of majority in your jurisdiction, you must have the consent of your parent or legal guardian. Children under 13 must not use the Services.

• Account and Security

  Provide accurate account information and keep your credentials secure. You are responsible for all activity under your account. Notify us promptly of any unauthorized access or suspected security incident.

• Plans, Fees, Taxes, and Renewals

  Some features require a paid subscription. Subscriptions automatically renew until canceled. Fees are non-refundable except where required by law. We may modify plan features or pricing with advance notice where legally required.

• Your Content and License to Peachy

  You retain ownership of content you submit to or through the Services (including links, QR targets, form configurations, images, text, and other materials). You grant Peachy a non-exclusive, worldwide, royalty-free license to host, process, transmit, display, adapt, and back up your content as necessary to operate, improve, and secure the Services, including abuse detection and prevention.

• End Users and Data Responsibility

  If you collect information from your own end users via Peachy pages, forms, or bookings, you act as the controller of that end-user data. Peachy acts as your processor and processes such data to provide the Services according to your instructions and our Privacy Policy and any Data Processing Addendum (DPA) executed with you. You must provide a privacy notice and obtain any required consents from your end users.

• Acceptable Use

  You will not use the Services to: phish, deceive, or distribute malware; violate laws, platform policies, or third-party rights; shorten or route to content that is unlawful, harmful, or infringes intellectual property or privacy rights; send spam, engage in scams, or attempt to bypass security controls; engage in hate, harassment, or child sexual abuse material (CSAM). We may scan, flag, block, deactivate, or replace links/QRs we believe are malicious, unlawful, or violate these Terms, and may suspend or terminate accounts for violations.

• Third-Party Services and Integrations

  Certain features connect to third-party platforms (e.g., Facebook, Instagram, WhatsApp). Your use of those features is governed by the third party’s terms and privacy policies. Peachy is not responsible for third-party services and does not control their data practices.

• Intellectual Property

  The Services, including their software, interfaces, and branding, are owned by Peachy or its licensors. Except for the limited rights expressly granted, no license is implied.

• Copyright

  If you believe content accessible via the Services infringes your copyright, please send a notice to privacy@peachy.io with sufficient detail to locate the material and evidence of ownership. We may remove or disable access to allegedly infringing material and process counter-notifications where applicable.

• Beta and Experimental Features

  We may offer beta or experimental features that are provided “as is” and may change or be discontinued at any time.

• Disclaimers

  To the maximum extent permitted by law, the Services are provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, or noninfringement. We do not warrant uninterrupted or error-free operation, or that links/QRs will always be available.

• Limitation of Liability

  To the maximum extent permitted by law, Peachy and its suppliers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, goodwill, or business interruption. Our aggregate liability for all claims relating to the Services will not exceed the amount you paid to us in the 12 months preceding the event giving rise to liability.

• Indemnity

  You will defend, indemnify, and hold harmless Peachy from and against any claims, liabilities, damages, losses, and expenses arising from your content, your sites/landing pages, or your misuse of the Services.

• Changes to the Services or Terms

  We may update the Services and these Terms from time to time. If changes materially affect you, we will provide reasonable notice as required by law. Your continued use after the effective date constitutes acceptance.

• Governing Law and Disputes

  These Terms and any non-contractual obligations are governed by the laws of the Hong Kong Special Administrative Region (HKSAR), excluding conflict-of-laws rules. The courts of Hong Kong have exclusive jurisdiction over any dispute arising out of or in connection with these Terms. If you are a consumer resident in the United Kingdom or the European Economic Area, you may bring claims in the courts of your habitual residence, and nothing in these Terms affects any non-waivable consumer rights under the laws of your country.

• Export, Sanctions, and Compliance

  You must comply with applicable export control and sanctions laws. You may not use the Services in jurisdictions embargoed by your applicable laws.

• Term and Termination

  You may stop using the Services at any time. We may suspend or terminate the Services or your account for cause (including legal risk, security threat, non-payment, or violation of these Terms). Sections relating to intellectual property, disclaimers, limitations, indemnity, and dispute resolution survive termination.

• Communications Compliance

  If you use Peachy’s messaging features, you must comply with Hong Kong’s Unsolicited Electronic Messages Ordinance (sender identity, unsubscribe, and do-not-call registers). You must honor opt-outs, maintain records of consent, and comply with all local anti-spam rules. Peachy may suspend messaging features for non-compliance.
